Terms of Service and User Agreement

1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ECL Sweden AB ("eclean," "Company," "we," "us," or "our"), a company registered in Sweden with registration number 559546-5831.

eclean is also operated by ECLEAN LIMITED (Company Number: 14953607, United Kingdom). ECL Sweden AB and ECLEAN LIMITED are two independent companies, each held eclean's co-founders — they are not subsidiaries of each other.

Depending on your location, either entity may be your contracting party (for example, UK residents may trade with ECLEAN LIMITED, while users elsewhere trade with ECL Sweden AB). The co-founders reserve the right to transfer intellectual property, data ownership, product rights, and trading responsibilities between the two entities. References to "we," "us," or "eclean" in these Terms include both ECL Sweden AB and ECLEAN LIMITED as the context requires.

By accessing, downloading, installing, or using eclean's software and services, you agree to be bound by these Terms, our Privacy Policy, our Cookie Policy, and our Refund and Return Policy. If you do not agree, do not use our Services.

2. Definitions

  • "Services" means the eclean desktop application, website (eclean.gg), cloud-based account features, Discord community, and any related services we provide.
  • "Software" means the eclean desktop application for Windows, including all updates, patches, and new versions.
  • "Consumer" means an individual acting outside their trade, business, craft, or profession.
  • "Subscription" means a paid plan that grants access to premium features for a specified period.
  • "User Data" means any data, configuration, or content you store through or generate by using the Services.

3. Description of Services

eclean is a PC maintenance and optimization application for Windows. We help you keep your computer fast, tidy, and private. Our Services include:

  • Desktop application for Windows 10 and Windows 11 (64-bit)
  • System optimization — Fine-tune Windows settings across privacy, security, performance, battery, and other categories with full undo history
  • System cleanup — Remove junk files, browser caches, temporary data, and large files, with optional secure file shredding
  • System monitoring — View hardware specs and real-time sensor data (CPU, memory, GPU, network, storage)
  • Startup and service management — Control startup apps, Windows services, DNS settings, and scheduled tasks
  • Software management — Uninstall Win32 and UWP apps, manage browser extensions, detect leftover files
  • Cloud account management — Sync your account, subscription, and preferences
  • Customer support via live chat and email

All changes the Software makes to your system (registry tweaks, service changes, file cleanup) are designed to be reversible. Every optimization can be undone through the app's built-in history.

Features and functionality may vary depending on your subscription tier. We may modify, enhance, or discontinue features with reasonable notice.

4. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and current registration information
  • Keep your account credentials secure
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activity under your account
  • Use only one account per person

Age Requirements: You must be at least 16 years of age to create an account and use our Services. If you are under 18, you should review these Terms with a parent or guardian.

5. Software License

Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

  • Download and install the Software on devices you own or control
  • Use the Software for its intended purpose (PC maintenance and optimization)
  • Access cloud features associated with your account and subscription tier

License Restrictions

You may not:

  • Copy, modify, or create derivative works of the Software
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code
  • Remove, alter, or obscure any proprietary notices or labels
  • Rent, lease, lend, sell, redistribute, or sublicense the Software
  • Use the Software to develop a competing product
  • Exceed the number of devices permitted by your subscription tier

Device Limits: Your subscription determines how many devices you can install the Software on (e.g., 1 device for Single, up to 5 devices for Family). Each device is identified by a hardware-based device ID.

6. Subscription Plans and Pricing

6.1 Subscription Tiers

We offer a free tier and paid subscription plans. Current plans, features, and pricing are listed on our website. At the time of writing, our paid plans include:

  • Single: Premium features for 1 device (annual billing)
  • Family: Premium features for up to 5 devices (annual billing)

The free tier is fully functional for basic use and is completely ad-free.

6.2 Billing and Payment

  • Payments are processed securely through Stripe
  • Subscription fees are billed monthly or annually in advance
  • All prices are shown in your selected currency and include applicable taxes where required
  • You authorize us to charge your payment method for recurring subscription fees

6.3 Auto-renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. We will notify you before renewal, and you can manage your subscription in your account dashboard.

6.4 Price Changes

We may change subscription prices with at least 30 days' advance notice. Price increases take effect at the start of your next billing period after the notice period. You may cancel before any price change takes effect.

7. Refund Policy

  • 14-day no-questions-asked refunds on all purchases, including renewals
  • 30-day money-back guarantee for first-time subscribers
  • Refunds are processed to your original payment method via Stripe

8. Consumer Rights (EU/Sweden)

If you are a Consumer in the European Union or Sweden, you have statutory rights under the Consumer Rights Directive and the Swedish Distance Selling Act (Distansavtalslagen).

8.1 Right of Withdrawal (Ångerrätt)

As a Consumer, you generally have the right to withdraw from a distance contract within 14 days without giving any reason. However, by purchasing a subscription and using the Services, you acknowledge that:

  • The supply of digital content begins immediately upon purchase
  • You expressly consent to this immediate performance
  • You acknowledge that you lose your right of withdrawal once the digital content has been fully delivered

Our 30-day money-back guarantee gives you more protection than the statutory minimum.

8.2 Statutory Warranty

Under EU Directive 2019/770 (Digital Content Directive), if the Services do not conform with our description or are not fit for purpose, you may be entitled to have the Services brought into conformity, receive a price reduction, or terminate the contract.

8.3 Non-waivable Rights

Nothing in these Terms limits or excludes any Consumer rights that cannot be limited or excluded under applicable law.

9. Acceptable Use Policy

You agree to use the Services only for lawful purposes. You must not:

  • Use the Services for any illegal, harmful, or fraudulent purpose
  • Attempt to gain unauthorized access to our systems, accounts, or data
  • Interfere with, disrupt, or overload our infrastructure
  • Transmit malware, viruses, or harmful code
  • Circumvent usage limits, access controls, or security measures
  • Resell or commercially exploit the Services without authorization
  • Impersonate any person or entity

10. What the Software does to your System

We want to be transparent about how eclean interacts with your PC:

  • Registry Changes: The Optimizer modifies Windows registry values to adjust system settings (privacy, performance, security, etc.). Every change is logged and can be individually reversed.
  • File Deletion: The Cleaner identifies and removes temporary files, caches, and junk. You review what will be deleted before confirming. Secure file shredding uses multi-pass overwrite for permanent deletion.
  • Service and Startup Management: The Booster can enable or disable Windows services, startup applications, and scheduled tasks. All changes are tracked and reversible.
  • Application Uninstallation: The Uninstaller removes software and detects leftover files. Uninstallation itself cannot be reversed once confirmed.
  • No Personal File Access: eclean does not open, read, modify, or delete your personal documents, photos, videos, or browsing history. It works only with system-level files and settings.

Important: While we design all optimizations to be safe and reversible, modifying system settings always carries inherent risk. We recommend reviewing changes before applying them and keeping system restore points as an additional safety net.

11. Service Availability and Support

11.1 Availability

The desktop application functions primarily offline—your PC optimizations, cleanup, and monitoring work without an internet connection. Internet access is needed for account management, license validation, updates, and cloud features.

We strive to keep our cloud services available but do not guarantee uninterrupted access.

11.2 Maintenance

We may perform scheduled maintenance from time to time. We will give reasonable advance notice of maintenance that may materially affect service availability. Emergency maintenance may occur without notice.

11.3 Support

All users receive email and live chat support. We typically reply within 2–4 hours during business hours. Free tier users have access to documentation and community support. Paid subscribers receive priority support.

12. Automatic Updates

The Software checks for updates on startup via our update service. Updates may include bug fixes, security patches, and new features. In rare cases, we may push an emergency update to address critical security or stability issues. The app includes rollback support if an update causes problems. You can configure update behavior in the app settings.

13. Intellectual Property

13.1 Our Intellectual Property

The Services, Software, and all content, features, and functionality are protected by international copyright, trademark, and other intellectual property laws. Intellectual property rights are currently held by ECL Sweden AB, but may be transferred to or shared with ECLEAN LIMITED.

13.2 Trademarks

"eclean," the eclean logo, and other eclean marks are trademarks currently held by ECL Sweden AB and may be transferred to or shared with ECLEAN LIMITED. You may not use our trademarks without prior written permission, except to refer to our products in a factual, descriptive manner.

13.3 Your Data

You retain all ownership rights in your User Data. By using the Services, you grant us a limited license to host, store, and process your User Data solely to provide the Services. We do not claim ownership of your data.

13.4 Feedback

If you provide feedback, suggestions, or ideas about the Services, you grant us a perpetual, irrevocable, royalty-free license to use and incorporate such feedback into our products without obligation to you.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS OR THAT OPTIMIZATIONS WILL ACHIEVE PARTICULAR PERFORMANCE RESULTS. SYSTEM PERFORMANCE DEPENDS ON MANY FACTORS BEYOND OUR CONTROL.

15. Limitation of Liability

15.1 Exclusion of Certain Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECL SWEDEN AB OR ECLEAN LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.

15.2 Liability Cap

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) €100.

15.3 Exceptions

These limitations do not apply to: (a) liability from fraud, gross negligence, or willful misconduct; (b) liability for death or personal injury caused by negligence; (c) any liability that cannot be excluded under applicable law; or (d) Consumer rights that cannot be waived.

16. Indemnification

You agree to indemnify and hold harmless ECL Sweden AB and ECLEAN LIMITED from claims, damages, and expenses (including reasonable legal fees) arising from your violation of these Terms or applicable laws.

17. Termination

17.1 Termination by You

You may cancel your subscription at any time through your account dashboard or by contacting us. You may delete your account at any time. Cancellation does not entitle you to a refund except as provided in our Refund Policy.

17.2 Termination by Us

We may suspend or terminate your account:

  • For material breach of these Terms
  • For non-payment after reasonable notice
  • If required by law or legal process
  • If your use poses a security risk to others
  • If we discontinue the Services entirely (with reasonable notice)

17.3 Effect of Termination

Upon termination:

  • Your license to use the Software ends immediately
  • You should uninstall the Software (it will no longer validate your license)
  • You may request export of your account data within 30 days
  • After 30 days, we may delete your account data
  • Optimizations and changes previously applied to your PC remain in place — you can reverse them before uninstalling, or use Windows System Restore
  • Provisions that should survive termination (intellectual property, limitation of liability, governing law) continue in effect

18. Data Handling after Termination

After account deletion, we retain your data for 30 days to allow you to request export or restore your account. After this period, data is deleted from our active systems. It may persist in encrypted backups for up to 90 days. Billing records are retained for 7 years as required by Swedish law. See our Privacy Policy for full details.

19. Export Control

The Services may be subject to export control laws. You agree not to export or transfer the Services to any country, entity, or person prohibited by applicable export laws or sanctions regulations.

20. Force Majeure

Neither party is liable for failure or delay in performance due to circumstances beyond reasonable control, including natural disasters, war, government actions, power or internet failures, cyberattacks, or pandemics. The affected party must provide prompt notice and use reasonable efforts to mitigate the impact.

21. Governing Law and Dispute Resolution

21.1 Governing Law

These Terms are governed by the laws of Sweden, without regard to conflict of law principles. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

21.2 Jurisdiction

Disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of Sweden, with venue in Stockholm, unless mandatory consumer protection laws require disputes to be heard in your local courts.

21.3 EU Online Dispute Resolution (Consumers)

If you are an EU Consumer, you may use the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr. Our email for ODR purposes is legal@eclean.gg.

22. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms to ECLEAN LIMITED, ECL Sweden AB, or any successor entity in connection with a restructuring, merger, acquisition, or sale of assets, provided the assignee agrees to be bound by these Terms.

24. General Provisions

24.1 Severability

If any provision is found unenforceable, it will be limited to the minimum extent necessary. The remaining provisions remain in full effect.

24.2 Waiver

Our failure to enforce any right does not constitute a waiver of that right.

24.3 Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Refund and Return Policy, constitute the entire agreement between you and ECL Sweden AB regarding the Services.

24.4 Language

These Terms are provided in English. If translated, the English version prevails in case of inconsistency.

25. Changes to these Terms

We may modify these Terms from time to time. Material changes take effect 30 days after posting, and we'll notify you by email or prominent notice within the Services. Your continued use after changes take effect constitutes acceptance. If you disagree, you may terminate your account.
